Court Hearings

2002

     Patricia filed for Divorce in February of 2002. Between her filing and our Final Decree in December of 2004 we averaged a hearing a month. We spent time in Family Court, Domestic Violence, Civil, Bankruptcy and finally Criminal. The majority of hearings were recorded and are public record.

     There was a hearing in either August or September of 2002 where Judge Angela Jewell dismissed the restraining order against me and we agreed to a mutual order limiting our contact. The record of this hearing has disappeared.

     In August, the Court appointed Guardian Ad Litem (GAL) moved our oldest son Glen out of Patricia’s care and into my home. Shortly thereafter Patricia took Glen’s dog to the pound and in the presence of our two youngest children, ordered the animal put to death.

     This seemed the turning point, from that day forward the system turned away from Patricia.

     When Patricia realized the negative response to her actions, she blamed Glen and filed Cruelty to Animal Charges against him. The theory she put forth was that Glen’s cruelty to the animal resulted in an unmanageable animal she was forced put to death.

     The State’s Children Youth and Families Department held a hearing on the matter on September 26, 2002. I hired my lawyer to represent Glen and the GAL was present along with Glen, my mother, and myself. Glen sat for an hour and listened his lawyer, the GAL, and his grandmother trash his mother. The hearing officer finally stopped the proceeding and said he was convinced of Patricia’s problems in the first few minutes. No record of this hearing exists other then the hearing officer’s decision not to proceed.

     In October, against the advice of her attorney, Patricia returned to the Domestic Violence Court in an attempt to enforce a restraining order that did not exist, alleging that I was driving by her house, threatening her, and relying threats through the children.

     I will note that I had no communication with Patricia during this time, that Glen’s school was literally across the street from the family home, and I will not dignify even the concept of conveying threats through children.

    This is also the first hearing where I suspected that decisions were being made outside of the courtroom, In my pervious hearing with Loretta Lopez she had refused to hear any unfiled motions raised by my attorney. As you can hear in this short hearing, the exact opposite occurred this time.
